1. Age and account
You must be at least 16 to use VSpot and 18, or the applicable age of majority, to organize activities, publish paid offers, receive funds or enter financial obligations. Provide accurate and current information, protect your credentials and report unauthorized use.
2. VSpot’s role and contracting parties
VSpot provides intermediation, communication, booking and payment-management tools. In Marketplace, the campaign is between the brand and creator; in Experience, the activity is between the organizer and participant. Unless expressly stated otherwise, VSpot is not the brand, creator, organizer or activity provider.
3. Profiles, offers and verification
Users are responsible for the identity, experience, qualifications, social links, images, claims and other information they publish. Unless a screen expressly shows a specific verification, VSpot does not guarantee identity, solvency, permits, insurance, qualifications, authenticity, availability, quality, safety or legality of a profile, campaign, Experience or place. Review the profile, reviews, requirements and conditions before participating.
4. Marketplace
The brand must accurately describe the campaign, reward, places, requirements, location, dates and deliverables. The creator must review them and complete the agreed check-in, creation and delivery. The parties are responsible for the product, advertising content, third-party rights, taxes and applicable legal compliance.
5. Experience, location and safety
The organizer must accurately describe the activity, schedule, capacity, price, requirements, risks and accessibility, provide a valid location and hold legally required permits, insurance, facilities and qualifications. Participants must assess suitability and follow safety instructions. The address is supplied by the organizer and is not independently guaranteed; it is disclosed to an accepted participant so it can be checked with the organizer.
6. Prices, payments and fees
The total and breakdown are shown before confirmation. Marketplace currently applies a 5% platform fee, plus displayed taxes and processing costs. Experience currently applies 3.9%, with a minimum €1 fee per paid booking. In countries supported by the online payment provider, paid Experiences use online payment; elsewhere, enabled options including cash may be shown. Free Experiences may carry an organizer publication fee displayed before publishing: currently €4.99 for up to 10 places and €0.50 per additional place where available. The payment provider processes cards, accounts and transfers; VSpot does not retain full payment numbers.
7. Cancellations, withdrawal and settlement
The conditions shown before confirmation apply. For an online-paid Experience, participant cancellation at least 24 hours before the start refunds the base price according to the breakdown; service fees and costs already incurred may be non-refundable where permitted by law. There is no automatic refund with less than 24 hours’ notice. After the Experience ends, organizer payout remains protected for 24 hours to allow claims; an open case may pause settlement. Leisure services for a specific date or period may be legally exempt from the 14-day withdrawal right. Mandatory consumer rights always prevail.
8. Check-in and attendance evidence
Check-in combines the booking, account, time, authorized location and a temporary QR code. Requesting and completing it is a declaration of presence and the record may be used as attendance evidence in a claim, but it is not irrebuttable. You may report account theft, coercion, technical error or unauthorized use. Sharing, falsifying or manipulating codes, location or records is prohibited.
9. Off-platform payments and agreements
Payments, refunds or arrangements made outside VSpot’s enabled methods are not processed, safeguarded or verified by the Platform and may fall outside its protection, tracking and resolution mechanisms, without limiting legal rights between the parties. Do not accept requests intended to bypass controls or fees.
10. Content and intellectual property
You retain ownership of your content and confirm that you hold the necessary rights. You grant VSpot a non-exclusive, worldwide licence for as long as necessary to host, technically adapt, display and distribute it to operate and promote the Platform and relevant offer. Licences in an accepted campaign also apply. Illegal content, fraud, impersonation, harassment, discrimination, rights infringement and manipulation of payments or reviews are prohibited.
11. Ranking and recommendations
Listings may be ordered by chosen filters, proximity, availability, relevance, information quality, activity, date or popularity. Approximate location may prioritize nearby results. Paid promotion, if introduced, will be identified. Criteria may change to improve usefulness, safety and fraud prevention.
12. Reports, moderation and sanctions
You can report content, profiles, conversations or transactions through available tools. We may combine automated and human review, request evidence, limit visibility, lock a conversation, remove content, suspend an account for the stated period or close it for serious or repeated breaches. We will communicate the reason and duration where legally and technically possible. The affected person may request support review. We retain the file needed to justify decisions and handle claims.
13. Claims and payment decisions
VSpot may facilitate a solution and, where it controls the payment flow, hold funds, issue a refund or release payment based on the verifiable transaction state, technical records and available evidence. We do not guarantee recovery or a favorable outcome. An internal decision does not replace rights before courts, consumer authorities, the payment provider or other competent bodies.
14. Liability
Users remain responsible for their conduct, activities, products, services, permits, taxes, safety and duties to third parties. To the maximum extent allowed, VSpot is not liable for false user information, changes or breaches between users, organizer-provided places or outside transactions. Nothing excludes liability that cannot legally be excluded, including VSpot’s own fraud or gross negligence, personal injury where applicable, data or payment duties and mandatory consumer rights.
15. Changes, law and contact
Spanish law applies without depriving consumers of mandatory protection in their country. Material changes will be notified and renewed acceptance requested where required. Use the contact at the end for support, reports, sanction reviews or legal claims.
